The Nigerian Bar Association Section on Public Interest and Development Law (NBA-SPIDEL) has formally cautioned the Nigeria Police Force against enforcing its controversial tinted glass permit policy while a Federal High Court suit challenging its legality remains pending.
In a strongly worded letter addressed to the Inspector General of Police, NBA-SPIDEL Chairman, Prof. Paul Ananaba, SAN, and Chairman of the Public Interest Litigation Committee, Olukunle O. Edun, SAN, expressed alarm at statements suggesting that the Nigeria Police Force intended to commence enforcement of the policy on 2nd October 2025, despite the ongoing Suit No: FHC/ABJ/CS/1821/2025, filed by the Incorporated Trustees of the Nigerian Bar Association against the Inspector General of Police and another.
The association underscored the settled legal principle that parties served with an Originating Summons and a Motion on Notice for Interlocutory Injunction are required to maintain the status quo until the court delivers its judgment. NBA-SPIDEL cited authoritative rulings from the Court of Appeal and the Supreme Court, includingOkeke-Oba v. Okoye (1994)andRegistered Trustees, Apostolic Church v. Olowoleni (1990), emphasizing that taking unilateral action during pending proceedings constitutes a blatant disregard for the majesty of the court.

Prof. Ananaba and Olukunle Edun warned that continued enforcement or incitement to enforce the policy could attract contempt proceedings. They specifically called out the Force Public Relations Officer, CSP Benjamin Hundeyin, for issuing statements indicating the Police Force’s intent to proceed, describing such actions as “egregious acts of contempt for the authority of the court.”
NBA-SPIDEL further advised AIG Ohiozoba O. Ehiede, Officer-in-Charge of the Directorate of Legal Services, to provide sound legal guidance to ensure the Nigeria Police Force respects judicial authority. Failure to comply, the association said, would prompt disciplinary proceedings before the Legal Practitioners Disciplinary Committee (LPDC).
The association concluded by urging the Inspector General to allow reason and the rule of law to prevail by halting any further enforcement of the tinted glass permit policy until the Federal High Court determines the legality of the policy.
