BREAKING: INEC Responds to Court Order Targeting Mahmood Yakubu’s Arrest

The Independent National Electoral Commission (INEC) has denied claims that it disobeyed a court order issued by the Federal High Court in Oshogbo, Osun State, 11 days ago.

Reports had surfaced that the court, on September 29, 2025, ordered the arrest of the immediate past INEC Chairman, Prof. Mahmood Yakubu, over alleged disobedience to its judgment in a case involving the Action Alliance (AA).

However, in a statement issued by Sam Olumekun, National Commissioner and Chairman of INEC’s Information and Voter Education Committee, the Commission dismissed the reports as misleading.

INEC explained that it had complied with the court’s directive before the deadline expired.

“In line with our long-established tradition of always obeying court judgments and orders, the Commission, on Monday, October 6, 2025, which was still within the deadline, filed processes at the Federal High Court, Oshogbo, to show that we had complied with its judgment and order of recognising the Action Alliance’s executive elected on October 7, 2023, in Abeokuta, Ogun State,” the statement read.

The Commission added that it tendered the dashboard of its website as evidence of compliance.

According to Olumekun, when the judgment creditors complained that INEC had only listed four national executives without including the party’s National Chairman, Rufai Omoaje, the Commission responded by presenting the Notice of Appeal filed by Omoaje at the Supreme Court, challenging the Court of Appeal’s decision that removed him as chairman.

“The judgment of the Court of Appeal is superior to that of the Federal High Court. Therefore, the Commission cannot list Omoaje’s name as the National Chairman of the Action Alliance while the Appeal Court’s judgment remains in force,” INEC stated.
